Chapter 66.--PUBLIC UTILITIES
Article 20.--TELECOMMUNICATIONS

      66-2006.   Lifeline service program; enrollment ofexisting and eligible customers; universal service fund.(a) On or before January 1, 1997, the commissionshall establish the Kansas lifeline service program, hereinafterreferred to as the KLSP. The purpose of the KLSP shall be topromote the provision of universal service by local exchangecarriers to persons with low income. The KLSP shall be targetedto maintain affordable rates for residential local exchangeservice. The commission shall approve a means test to determinethe eligibility of customers for such low-income assistance.

      (b)   Every local exchange carrier providing residential localtelecommunications servicesthat have been price deregulated in this state pursuant to subsection (q) ofK.S.A. 66-2005, and amendments thereto, shall, and anyother local exchange carrier or telecommunications carrier may, automaticallyenroll its existingand eligible customers in the KLSP, subject to the following:

      (1)   On or before January 1, 2009, the department of social and rehabilitationservices,hereinafter referred to as the department, or any other successor state agency,may provide eachparticipating carrier a list of those persons residing in the state thatparticipate in programs whichalso qualify such persons to receive KLSP services. This listing shallconsist of those personswho have consented to the release of their personal information to the KLSPcarrier to receive KLSP services and include at a minimum the name,address andtelephone number of such persons. Every six months thereafter, the departmentmay provide toeach participating carrier an updated list of persons consenting to such KLSPservices. Thesecretary of the department may adopt rules and regulations to coordinate theacquisition andprovision of the information to be provided pursuant to this subsection (b).

      (2)   The participating carrier shall use the list for the sole purpose ofidentifying those ofits existing customers to whom it is currently providing telephone service.

      (3)   The participating carrier shall discontinue providing KLSP services to aneligiblecustomer if the eligible customer notifies the participating carrierthat the customer wishesto discontinue receiving those services.

      (4)   Each participating carrier receiving customer information pursuant tothis subsection(b) shall execute a confidentiality agreement with the department prior toreceiving non-publiccustomer eligibility information. The agreement will specify that the customerinformation isreleased by the department to the participating carrier for the sole purpose ofproviding KLSP toeligible customers, and that the information cannot be released or used by thecarrier for anyother purpose unless authorized by the customer or otherwise required bylaw.

      (c)   To generate and facilitate participation in the lifeline service program,provide choice for Kansas consumers, and allow collection of federal lifelineprogram reimbursements, the KCC shall approve a wireline (non-CMRS)facilities-based telephone service provider's application for eligibletelecommunications carrier, hereinafter referred to as the ETC, designation ina nonrural service area for the purpose of receiving low-income federaluniversal service fund support for participation in the lifeline serviceprogram, for the area equal to the applicant provider's own service area,provided the applicant provider meets all other ETC eligibilityrequirements. The commission, however, may condition that such designationremain consistent with the guidelines of the federal program.
