Chapter 68.--ROADS AND BRIDGES

Article 15.--BRIDGES AND DAMS ACROSS NAVIGABLE STREAMS

      68-1502.   Plans and specifications; approval; flood gates.Any municipality, corporation, person or individual desiring toconstruct a bridge, dam or other obstruction for either public or privatepurposes, or to repair or maintain a bridge, dam or other obstructionalready constructed, over any of the navigable rivers of the state, shallprepare plans and specifications, together with the data upon which they arebased, and shall, when such bridge or dam forms part of apublic highway, submit the plans, specifications and data to thesecretary of transportation for thesecretary's inspection and approval. When the plans and specifications areapproved by the secretary, the municipality, corporation, personor individual is authorized and empowered to construct, repair and maintainsaid bridge or bridges, dam or dams, or other obstructions according to theplans and specifications approved by the secretary of transportation and underthe direction and supervision of thesecretary. No plans for the construction ofanysuch dam shall be approved, and no such dam shall be constructed unless itcontains flood gates or openings that can be opened in times ofhigh water,so as to prevent the overflow of lands in the vicinity of the dam.
