Article 20.--TOLL ROADS OR TURNPIKES

      68-2003.   Kansas turnpike authority; membership; terms;qualifications; vacancies; removal, when; oath or affirmation; officers;quorum; compensation and expenses.There is hereby created a body politic and corporate to be known as theKansas turnpike authority. The authority is hereby constituted apublic instrumentality and the exercise by the authority of the powersconferred by this act in the construction, operation and maintenance ofturnpike projects shall be deemed and held to be the performance of anessential governmental function.

      The Kansas turnpike authority shall consist of five members. Two membersshall be appointed by the governor for terms of four years. The membersappointed by the governor shall be residents of the stateand shall each year be owners of revenue bonds issued bythe Kansas turnpike authority. One member of the authority shallbe the secretary of transportation. One member shall be the chairpersonof the committee on transportation and tourism of the senate,and one member shall be a member of the committee ontransportation of the house of representatives and shall be appointed bythe speaker of the house of representatives. Any person appointed by thegovernor to fill avacancy on the authority shall beappointed to serve only for the unexpired term, and a member of theauthority shall be eligible for reappointment. A member of theauthority may be removed by the governor for misfeasance, malfeasance orwillful neglect of duty, but only after reasonable notice and a publichearingconducted in accordance with the provisions of the Kansas administrativeprocedure act. Each member ofthe authority, before entering upon the member'sduties, shall take andsubscribe an oath or affirmation as required by law.

      The authority shall elect one member as chairperson of theauthority and another as vice-chairperson. The authority shall also elect asecretary-treasurer who need not be a member of the authority. The chairperson,vice-chairperson and secretary-treasurershall serve asofficers at the pleasure of the authority. Three members of theauthority shall constitute a quorum and the affirmative vote of three membersshall be necessary for any action taken by the authority. Novacancy in the membership of the authority shall impair the right of aquorum to exercise all the rights and perform all the duties of theauthority.

      Members of the Kansas turnpike authority attending meetings of suchauthority, or attending a subcommittee meeting thereof authorized bysuch authority, shall be paid compensation, subsistence allowances,mileage and other expenses as provided in K.S.A. 75-3223 and amendmentsthereto.
