Chapter 68.--ROADS AND BRIDGES
PART III.--MISCELLANEOUS
Article 20.--TOLL ROADS OR TURNPIKES

      68-2051.   Definitions.As used in this act, the following words and terms shall have thefollowing meanings, unless the context shall indicate another ordifferent meaning or intent:

      (a)   The word "authority" shall mean the Kansas turnpike authorityduly created by K.S.A. 68-2003, or, if said authority shallbe abolished, the board, body or commission succeeding to the principalfunctions thereof or to whom the powers given by this act to theauthority shall be given by law.

      (b)   The word "project" or the words "turnpike project" shall meanthe modern express highway or any part or parts thereof constructedunder the provisions of this act by the authority, including allbridges, tunnels, overpasses, underpasses, interchanges, entranceplazas, approaches, toll houses, service stations, and administration,storage and other buildings and facilities which the authority may deemnecessary for the operation of the project, together with all property,rights, easements, and interests which may be acquired by the authorityfor the construction or the operation of the project.

      (c)   The word "cost" as applied to the turnpike project shall embracethe cost of construction, the cost of the acquisition of all land,rights-of-way, property, rights, easements and interests acquired by theauthority for such construction, and the cost of demolishing or removingany buildings or structures on land so acquired, including the cost ofacquiring any lands to which such buildings or structures may be moved,the cost of all machinery and equipment, financing charges, interestprior to and during construction, and, if deemed advisable by theauthority, for a period of not exceeding two (2) years after completionof construction, the funding of a debt service reserve, cost of trafficestimates and of engineering and legal services, plans, specifications,surveys, estimates of costs and of revenues, other expenses necessary orincident to determining the feasibility or practicability ofconstructing the project, administrative expense, and such otherexpenses as may be necessary or incident to the construction of theproject, the financing of such construction and the placing of theproject in operation. The word "cost" may also include not in excess offorty thousand dollars ($40,000) to be used by the authority for payingfees and expenses of engineers for making traffic studies, surveys andestimates of cost and of revenues, legal fees and expenses and otherexpenses necessary or incident to determining the feasibility orpracticability of constructing the project: Provided, That in theevent revenue bonds are issued as provided for in this act all or anypart of such forty thousand dollars ($40,000) shall be reimbursed to thestate highway fund for any expenses paid from said fund for the purposesspecified in K.S.A. 68-2067. Any obligation or expensehereafter incurred by the secretary of transportation with the approvalof the authority for traffic surveys, borings, preparation of plans andspecifications, and other engineering services in connection with theconstruction of the project shall be regarded as a part of the cost ofthe project and shall be reimbursed to the secretary out of the proceedsof the turnpike revenue bonds hereinafter authorized.

      (d)   The words "public highways" shall include all public highways,roads and streets in the state, whether maintained by the state or byany county, city, township or other political subdivision.

      (e)   The word "bonds" or the words "turnpike revenue bonds" shallmean the revenue bonds of the authority authorized under the provisionsof this act.

      (f)   The word "owner" shall include all individuals, co-partnerships,associations or corporations having any title or interest in anyproperty, rights, easements or interests authorized to be acquired bythis act.
