Chapter 68.--ROADS AND BRIDGES PART I.--ROADS Article 4.--STATE HIGHWAYS

68-408a. Bids; electronic submission.(a) The secretary of transportation is hereby authorized toimplement electronic submission of sealed bids as a procurement processaccessible by highway construction contractors and other qualified contractorsfor highway projects. Prior to implementing such procurement process, thesecretary of transportation shall adopt any policies and procedures which arenecessary for the acceptance of sealed bids by electronic on-line submission.

The secretary of transportation may adopt any rules and regulations necessaryto implement the provisions of this section.

(b) The secretary of transportation shall not acquire any goods or servicesthrough any process of reverse auctioning.

(c) As used in this section, "sealed bids" may include a procurement processfollowing procedures approved by the secretary of transportation in which bidsare received electronically over the internet.
