Chapter 71.--SCHOOLS--COMMUNITY COLLEGES
Article 6.--STATE AID AND FISCAL PROVISIONS

      71-604.   State entitlements; proration ofinsufficient appropriation; overpayments; underpayments.(a) If the amount of any appropriation for state entitlements is insufficientto pay in full the amount each community college is entitled to receive, theamount appropriated shall be prorated among all community colleges inproportion to the amount each is entitled to receive.

      (b)   If any community college is paid more than the amount it is entitled toreceive, the state board shall notify the community college of the amount ofthe overpaymentand the community college shall remit the same to the state board and the stateboard shall deposit the same in the state treasury to the credit of the generalfund, and if anysuch community college fails so to remit, the state board shalldeduct the excess amount so paid from future payments becoming due tosuch community college.

      (c)   If any community college is paid less thantheamount it is entitled to receive,the state board shallpay the additional amount due at any time within the fiscal year inwhich the underpayment was made or within 60 days after the endof such fiscal year.
