Chapter 72.--SCHOOLS
Article 17.--SUPPLEMENTAL RETIREMENT SYSTEMS

      72-1791.   Same; retirement and payment on account of disability, when;reinstatement.Any teacher who has been credited under the rules and regulations ofsuch board of education with an aggregate of twenty-five or more years ofteaching experience may be retired by such board of education on account ofdisability or incapacity, physical or otherwise. Any teacher so retired,provided that at least fifteen years of such accredited teaching experienceshall have been in the public schools of said cities, shall be entitled toreceive from such retirement fund during the period of retirement, monthlyinstallments, the annual aggregate of which shall be such percentage of thecomputed annual annuity as the number of years of such accredited teachingexperience of the beneficiary shall bear to the term of thirty years. Anyother public school employee, who has been credited under the rules andregulations of such board of education, with an aggregate of twenty-five ormore years of accredited experience, may be retired by such board ofeducation on account of disability or incapacity, physical or otherwise.

      Any other public school employee so retired, provided that at leastfifteen years of such accredited experience shall have been in the publicschools of such cities shall be entitled to receive from such retirementfund, during the period of retirement, monthly installments, the annualaggregate of which shall be such percentage of the computed annuity as thenumber of years of such accredited experience of the beneficiary shall bearto the term of thirty years. Any teacher or other public school employee soretired may, at the discretion of the board of education, should suchteacher's or other public school employee's incapacity or disability beremoved, be reinstated as a teacher or other public school employee and anyright to any payments from this fund until such teacher or other publicschool employee again be retired shall cease with such reinstatement. Andshould any teacher or other public school employee be so reinstated, theyears of such retirement shall be included in arriving at the term ofservice when such teacher or other public school employee may again beretired, but no credit for such years of retirement shall be given inarriving at the amount such teacher or other public school employee shallbe entitled to receive from the retirement fund.
