Article 44.--CAREER TECHNICAL EDUCATION

      72-4417.   Tuition and fees of students;liability; schedule.(a) Students admitted to a vocational education course or program whichis conducted by the school district in which the student is enrolled may becharged fees but shall not be charged tuition.

      (b)   Postsecondary students admitted to a vocational education courseor program shall pay tuition and fees as provided by laws applicable thereto.

      (c) (1)   Except as provided in paragraph (2) of this subsection,studentsadmitted to a vocational education course or programwhich is conducted by a community college shall pay tuition andfees as provided by laws applicable to community colleges andthe provisions of this section shall not apply thereto, nor shall anyprovisions of this act which are inconsistent with laws relating tocommunity college tuition and fees apply to communitycolleges.

      (2)   Students admitted to a vocational education course or program underthe provision of K.S.A. 71-1706 and which is conducted by a communitycollege which is consolidated with an area vocational school or areavocational-technical school may be charged fees but tuition shall be paid asprovided in paragraph (2) of subsection (d).Nothing in this act shall be construed to amend, repeal or inany way change laws relating to community college student orout-district tuition.

      (d)   Students admitted to a vocational educationcourse or program which is not conducted by the school district in whichthe student is enrolled shall be chargedtuition and fees determined inaccordance with subsection (e), subject however to thefollowing: (1) Tuition or fees, or tuition and fees may be paid for thestudent in accordancewith any agreement made under K.S.A. 72-4421, and amendments thereto; or

      (2)   if tuition of a student is not paid underprovision (1) of thissubsection, the tuition of the student shall be paid by the schooldistrict in which the student is enrolled. No school districtshall pay tuition for a student who is a postsecondary student,and no school district shall be required to pay tuition or feesof a student who is eligible to have tuition and fees for the courseor training the student selects paid by any state or federalagency from moneys,funds or appropriations madeavailable under any one or morefederal programs. Any state agency administering any one or more suchprograms shall pay such tuition and fees upon proper application bya student therefor.

      (e)   All tuition and fees charged for vocational education by anyboard shall be in such amounts as are authorized by rules andregulations adopted by the state board which shallestablish general guidelinesfor tuition and fee schedules in vocational education courses andprograms, except that tuition of postsecondary students shall be fixedin accordance with K.S.A. 72-4433, and amendments thereto. Theparticular tuition and fee schedule ofevery vocational education program shall be subject to annual approvalof the state board. A current complete schedule of tuition and fees foreach vocational education course and program of each board as approvedby the state board shall be maintained on file in the office of thestate board, and shall be open for public inspection at anyreasonabletime.
