Chapter 72.--SCHOOLS
Article 44.--CAREER TECHNICAL EDUCATION

      72-4442.   Capital outlay aid; determination ofamounts; payments; disposition;overpayments, underpayments.The amount of vocational education capital outlay aid for each school shallbe determined by the state board on the basis of need and the conditionof existing facilities and equipment and payments thereof shall be distributedon payment dates to be determined by the state board. The state board shallcertify to the director of accounts and reports the amount due as vocationaleducation capital outlay aid to each school five days before eachpaymentdate. The director of accounts and reports shall draw warrants on the statetreasurer payable to the treasurer of each school entitled to payment ofvocational education capital outlay aid, pursuant to vouchersapproved by the stateboard or by a person or persons designated by the state board. Upon receiptof such warrant, the treasurer of each area vocational school shall deposit theamount thereofto the credit of the area vocational school fund. Thetreasurer of each areavocational-technical school shall deposit the amount of such warrant tothe credit of the vocational education capital outlay fund established by thisact.

      In the event any school is paid more than it is entitled to receive underany distribution made under this act, the state board shall notify the schoolof the amount of such overpayment, and such school shall remit the sameto the state board. The state board shall remit any moneys so receivedto the state treasurer in accordance with the provisions ofK.S.A. 75-4215,and amendments thereto. Upon receipt of each such remittance, the statetreasurer shall deposit the entire amount inthe state treasury to the credit of the state general fund. If any suchschool fails so to remit, the state board shall deduct the excess amountsso paid from future payments becoming due to such school. In the eventany school is paid less than the amount to which it is entitled under anydistribution made under this act, the state board shall pay the additionalamount due at any time within the school year in which the underpaymentwas made or within 60 days after the end of such schoolyear.
