Chapter 72.--SCHOOLS
Article 53.--MISCELLANEOUS PROVISIONS

      72-5392.   Special education services for exceptionalchildren enrolled in private schools; definitions.As used in this act:

      (a)   "School district" means any public school district organized underthe laws of this state.

      (b)   "Exceptional children" and "specialeducation services" have the meanings respectivelyascribed thereto in K.S.A. 72-962, and amendments thereto.

      (c)   "Private, nonprofit elementary or secondary school" means an organizationwhich regularly offers education at the elementary or secondary level, whichis exempt from federal income taxation under section 501 of the federalinternal revenue code of 1954, as amended, which conforms to the civil rightsact of 1964, and attendance at which satisfies any compulsory school attendancelaws of this state.
