Chapter 72.--SCHOOLS
Article 64.--SCHOOL DISTRICT FINANCE AND QUALITY PERFORMANCE

      72-6454.   Nonproficient pupil weighting;determination in the event of disasters.(a) The nonproficient pupil weighting of each district shall bedetermined bythe state board as follows:

      (1)   Determine the number of pupils who were not eligible for free mealsunder the national school lunch act and who scored below proficiency or failedto meet the standards established by the state board on eitherthe mathematics or reading state assessments in the preceding school year; and

      (2)   multiply the number determined under paragraph (1) by .0465. The productis the nonproficient pupil weighting of the district.

      (b)   If the state board determines that as a result of the occurrence of adisaster in the school district, pupils in the school district are unable toparticipate in the state assessments, the nonproficient pupil weighting of theschool district shall be equal to the nonproficient pupil weighting of thedistrict in the preceding school year.

      As used in this subsection, "disaster" means the occurrence of widespread orsevere damage, injury or loss of life or property resulting from any natural ormanmade cause, including but not limited to fire, flood, earthquake, tornado,wind, storm, drought, epidemics, air contamination, blight, drought,infestation or explosion.
