Chapter 72.--SCHOOLS
Article 9.--SPECIAL EDUCATION

      72-973a.   Same; list and appointment of hearingofficers; procedure.Prior to appointing any hearing officer to conduct a due process hearingprovided for under this act, the agencyshall make its list ofhearing officers available to the parent of theinvolved childand shall inform the parent of the right torequest disqualificationof any or all of the hearing officers on the list and to request the stateboard to appoint a hearing officer in accordance with the procedure providedin this subsection. If the parent does notgive written notice of disqualificationto the agency within five days after the parent receives the list, theagency may appoint from its list anyhearing officer whom the parent has notrequested to be disqualified.If the parent requests disqualification of allof the hearingofficers and requests the appointment of a hearing officer by the stateboard, the agency shall immediately notify the state board and shall requestthe state board to appoint a hearing officer.
