Chapter 72.--SCHOOLS
Article 9.--SPECIAL EDUCATION

      72-975.   Administration of oaths; issuance ofsubpoenas; extension oftime; costs; hearing for additional evidence.(a) Any person conducting a hearing orreview underthis act mayadminister oaths for the purpose of taking testimony therein.

      (b)   Any person conducting a hearing orreview underthis act or anyparty to any such hearing or review may request the clerk of thedistrict court to issue subpoenas for the attendance and testimony ofwitnesses and the production of all relevant records, tests, reports andevaluations in the same manner provided for the issuance of subpoenas incivil actions pursuant to K.S.A. 60-245, and amendments thereto.

      (c)   Any person conducting a hearing orreview underthis act, atthe request of either party, may grant specific extensions of timebeyond the limitations specified in this act.

      (d)   Any person conducting a hearing under this act shall consider anyrequestfor discovery in accordance with the provisions of K.S.A. 77-522, andamendments thereto, exceptthat depositions of witnesses who will be available for the hearing shall notbe allowed.

      (e)   Every hearing and review under this act shall be providedfor at no cost to the child orthe parentof the child. The costs of any hearing provided for by a board shall bepaid by the school district.

      (f)   Any review officer conducting areview under this act may hold a hearing toreceive additionalevidence. Every such hearing shall be conducted in accordance with requirementswhich are consonant with the requirements of this act.
