Chapter 72.--SCHOOLS
Article 9.--SPECIAL EDUCATION

      72-976.   Requirements for education of children withdisabilities in regular classes, exception; admission to stateinstitutions.(a) Each school district shall be required,tothe maximum extent appropriate, to educate children with disabilitieswith children who are notdisabled, and to provide special classes, separate schooling or for the removalof children withdisabilities from the regular education environment only when the nature orseverity of thedisability of the child is such that education in regular classes withsupplementary aids andservices cannot be achieved satisfactorily.

      (b)   Nothing in this section shallbe construed toauthorize the state board or any board to function as an admittingagency to the state institutions or to limit or supersede or in anymanner affect the requirements of each board to comply with theprovisions of K.S.A. 72-966, and amendmentsthereto, to provide special education services for each exceptionalchild in the school district unless and until such child meets thecriteria for admission to a state institution and is so admitted by thestate institution. Each state institution shall publish thecriteria for admission to such state institution and shall furnish suchcriteria to each board upon request therefor.
