Chapter 72.--SCHOOLS
Article 9.--SPECIAL EDUCATION

      72-990.   Notice of parental rights;contents.The notice required by subsection (b)(2) of K.S.A. 72-988, andamendmentsthereto, shall include:

      (a)   A description of the action proposed or refused by the agency;

      (b)   an explanation of why the agency proposes or refuses to take the action;

      (c)   a description of other options that the agency or IEPteam considered and thereasons thoseoptions were rejected;

      (d)   a description of each evaluation procedure,assessment, record, or report theagency used as abasis for the proposed or refused action;

      (e)   a description of any other factors that are relevant to the agency'sproposal or refusal;

      (f)   a statement that the parents have protection under the proceduralsafeguards of this actand, if the notice is not an initial referral for evaluation, the means bywhich a copy of theprocedural safeguards can be obtained; and

      (g)   sources for parents to contact to obtain assistance in understanding theprovisions ofthe federal law and this act.
