Section 1B. If it appears in the petition for the probate of will that the surviving spouse of the deceased person is incompetent by reason of insanity, mental retardation or minority, or is under conservatorship, unless the spouse is represented by someone other than the petitioner, a guardian ad litem shall be appointed and made a party to the petition and shall be given notice of all proceedings relative to the probate of the will or granting of letters testamentary.
