Section 5. If a person named as executor in a will has deceased or refuses to accept the trust, or, after being duly cited for the purpose, neglects to accept the same or neglects for twenty days after the probate of the will to give bond according to law, the court shall grant letters testamentary to the other executors, if there are any competent and willing to accept the trust.
