Section 38. The court may at any time during the continuance of the trust on like petition and other proceedings as provided in sections twenty-six to thirty-seven, inclusive, decree that any income then accrued or thereafter accruing for the benefit of such absentee shall be paid to the persons as trustees to whom, and at the time or times and in the shares and proportions in which, it would be distributed if said absentee had died on the day fourteen years after the date of the disappearance or absconding, as found and recorded by the court.
