LOSS OR DESTRUCTION OF PUBLIC RECORDS (EXCERPT)

561.3 Public records; form.

Sec. 3.

The order for appearance shall be substantially in the following form or in such other form as may be prescribed by order of the court:

STATE OF MICHIGAN IN THE CIRCUIT COURT FOR THE COUNTY OF IN CHANCERY

State of Michigan. In Re Petition to Establish and Quiet Title to Lands and Recreating Public Records Thereof Under Act .................... of the Public Acts of 1944, First Extra Session.

In the name of the people of the State of Michigan. To all persons claiming any interest in or lien upon the real property herein described or any part thereof including their unknown heirs, devisees, legatees and assigns, as the case may be, greetings:

Take notice, that the record title to all of the lands in .......... county is in question by reason of the loss or destruction of records in the office of the register of deeds thereof, and in consequence thereof on the .................. day of .................. A.D. 19...., a bill of complaint was filed in the circuit court for the county of ................... in chancery, to establish and quiet title to the aforementioned lands, more particularly described as: (here insert a description of the real property in said county as contained in the bill of complaint and such additional descriptive language as may be ordered by the court). Now, unless you appear on or before the ................. day of ................., 19...., in said court, (naming a return day at least 90 days from the date of said order of appearance) and show your interest in any part of said aforedescribed real property, said bill of complaint shall be taken as confessed, and a decree entered pursuant to Act No. ............... of the Public Acts of 1944 Extra Session. Your appearance in (here insert number of this act) this action shall be substantially in the following form or in such other form as may be prescribed by order of the court.

Any and all persons appearing hereunder shall state the address at which they can be served with process in any proceedings under this act, and shall file with the register of deeds of the county any change of address, which change shall be noted by the register of deeds on the margin of the recorded appearance.
