Proposals, how selected--reevaluation, when--new solicitation ofproposals.

8.681. When selecting a construction manager for a project,the public owner shall consider the following for eachconstruction manager who has submitted a proposal: fees foroverhead and profit; reimbursable costs for reimbursable items asdefined in the public owner's request for proposal;qualifications; demonstration of ability to perform projectscomparable in design, scope and complexity; demonstration of goodfaith efforts to achieve compliance with federal, state and localaffirmative action requirements; references of owners for whomconstruction management has been performed; financial strength;qualifications of in-house personnel who will manage the project;and the demonstration of successful management systems which havebeen employed for the purposes of estimating, scheduling and costcontrols. The public owner may negotiate a contract forconstruction management services with any construction managerthus selected. If the public owner is unable to negotiate acontract for the type of services required with any of theconstruction managers selected for a project at a pricedetermined by the public owner to be fair and reasonable, thepublic owner shall reevaluate the necessary constructionmanagement services, including the scope and reasonable feerequirements, and again advertise and solicit proposals fromconstruction managers complying with the terms of the revisedrequests for proposal.
