Direct purchases and emergency purchases, when authorized, procedure.

34.100. The commissioner of administration may, when in thecommissioner's best judgment it is in the best interests of the state,delegate the commissioner's procurement authority pursuant to this chapterto an individual department; provided, however, that each instance ofsingle feasible source purchasing authority in excess of five thousanddollars under section 34.044 must be specifically delegated by thecommissioner. The delegation may allow departments to negotiate inaccordance with section 34.042 the purchase of services for patients,residents or clients with funds appropriated for this purpose. Inaccepting this delegated authority the department acknowledges its abilityto, and agrees to, fulfill all of the requirements of this chapter inmaking purchases and entering into contracts and keeping records. No claimfor payment based upon any purchase under this section shall be certifiedby the commissioner unless accompanied by such documentation of compliancewith the provisions of this chapter as the commissioner may require. Anydepartment that fails to fulfill all such requirements may have itsdelegated authority rescinded by the commissioner of administration.
