Personnel division, head, functions--administration of law, equalopportunity law.

36.040. 1. The division of personnel of the office ofadministration, the administrative head of which is the personnel director,shall administer this chapter and render the services to the departmentsand divisions subject to the provisions of this chapter that are necessaryand desirable to assist the officials in discharging their responsibilityfor maintaining and increasing the effectiveness of personneladministration. The division shall provide consultation and expertise inpersonnel management to all agencies to assist in the accomplishment of themissions of such agencies.

2. The division shall administer this chapter in a manner whichcomplies with equal opportunity law and shall consult with the state equalemployment opportunity officer in various aspects of the administration ofthis chapter to ensure such compliance. In particular, the division shallconsult with the state equal employment opportunity officer regarding theclassification plan, the pay plan, qualifications for admittance toexaminations, noncompetitive registration and selection procedures, waiverof competitive examinations, noncompetitive promotions, alternativepromotional procedures, alternatives for filling vacancies, and layoffactions, for the purpose of ensuring compliance with equal opportunity lawand regulations and on developed plans to establish a state workforce whichreflects the diversity of Missouri citizens at all levels of employment.
