Director to prepare pay plan.

36.140. 1. After consultation with appointing authorities and thestate fiscal officers, and after a public hearing, the director shallprepare and recommend to the board a pay plan for all classes subject tothis chapter. The pay plan shall include, for each class of positions, aminimum and a maximum rate, and such provision for intermediate rates asthe director considers necessary or equitable. The pay plan may includeprovision for grouping of management positions with similar levels ofresponsibility or expertise into broad classification bands for purposes ofdetermining compensation and for such salary differentials and other paystructures as the director considers necessary or equitable. Inestablishing the rates, the director shall give consideration to theexperience in recruiting for positions in the state service, the rates ofpay prevailing in the state for the services performed, and for comparableservices in public and private employment, living costs, maintenance, orother benefits received by employees, and the financial condition andpolicies of the state. These considerations shall be made on a statewidebasis and shall not make any distinction based on geographical areas orurban and rural conditions. The pay plan shall take effect when approvedby the board and the governor, and each employee appointed to a positionsubject to this chapter after the adoption of the pay plan shall be paidaccording to the provisions of the pay plan for the position in which he orshe is employed; provided, that the commissioner of administrationcertifies that there are funds appropriated and available to pay theadopted pay plan. The pay plan shall also be used as the basis forpreparing budget estimates for submission to the legislature insofar assuch budget estimates concern payment for services performed in positionssubject to this chapter. Amendments to the pay plan may be recommended bythe director from time to time as circumstances require and such amendmentsshall take effect when approved as provided by this section. Theconditions under which employees may be appointed at a rate above theminimum provided for the class, or advance from one rate to another withinthe rates applicable to their positions, shall be determined by theregulations.

2. Any change in the pay plan shall be made on a uniform statewidebasis. No employee in a position subject to this chapter shall receivemore or less compensation than another employee solely because of thegeographical area in which the employee lives or works.
