Provisional appointments--approval of director--for what period.

36.260. 1. When an appointing authority finds it essential to fill avacancy in a position subject to this chapter, and, with at least thirtydays' notice of the vacancy, the director is unable to certify the names ofat least ten available eligibles, the director may authorize the appointingauthority to fill the vacancy by means of a provisional appointment. Theappointing authority shall forthwith submit a statement containing the nameof a person nominated by the appointing authority for provisionalappointment to the position, which statement shall contain a description ofthe qualifications of training and experience possessed by that person, andsuch other information as may be required by the regulations. If suchnominee is found by the director to possess experience and training whichmeet the qualifications for the position, the director may approve theprovisional appointment.

2. No provisional appointment shall be made without the approval ofthe director.

3. The duration of a provisional appointment shall be the same as theduration of the probationary period established for the position. Aprovisional appointee who successfully completes the working test of theprobationary period may receive a regular appointment without examination.
