State judge advocate, appointment, qualifications--assistantjudge advocates, appointment, qualifications, restrictions.

40.017. 1. The adjutant general shall appoint a judgeadvocate officer of the state military forces as state judgeadvocate. To be eligible for appointment, such officer shallhave been a member of the Missouri Bar for at least five years,and shall have satisfactorily completed all educationalrequirements for active military service as a field grade judgeadvocate general corps officer or air national guard equivalent.

2. The adjutant general may appoint as many assistant statejudge advocates as he considers necessary. To be eligible forappointment, assistant state judge advocates must be officers ofthe state military forces and members of the Missouri Bar.

3. The state judge advocate or his assistants shall makeinspections in the field in supervision of the administration ofmilitary justice.

4. Convening authorities shall at all times communicatedirectly with their staff judge advocates or legal officer inmatters relating to the administration of military justice; andthe staff judge advocate or legal officer of any command isentitled to communicate directly with the staff judge advocate orlegal officer of a superior or subordinate command, or with thestate judge advocate.

5. No person who has acted as member, military judge, trialcounsel, assistant trial counsel, defense counsel, assistantdefense counsel, or investigating officer, or who has been awitness for either the prosecution or defense, in any case maylater act as staff judge advocate or legal officer to anyreviewing authority upon the same case.
