Absent without leave, authority to apprehend--offender outsidestate, procedure.

40.023. Any civil officer having authority to apprehendoffenders under the laws of the United States or of a state,territory, commonwealth, or possession, or the District ofColumbia, or any military officer subject to sections 40.005 to40.490 who has been authorized by the governor by regulation maysummarily apprehend any person subject to sections 40.005 to40.490 who is absent without leave from the state military forcesand deliver him into the custody of the state military forces.If an offender is apprehended outside the state, his return tothe area must be in accordance with normal extradition proceduresor reciprocal agreement.
