Copy of charges served on accused by trial counsel--timerequirement before he can be brought to trial.

40.121. The trial counsel to whom court-martial charges arereferred for trial shall cause to be served upon the accused acopy of the charges upon which trial is to be had. In time ofpeace, no person shall, against his objection, be brought totrial, or be required to participate by himself or counsel in asession called by the military judge under section 40.130 in ageneral court-martial case within a period of five days after theservice of the charges upon him, or in a special court-martialwithin a period of three days after the service of the chargesupon him.
