Sentence approval by governor required, when--governor's powers--sentence approval by convening authority, powers.

40.216. 1. No sentence extending to the dismissal of acommissioned officer or dishonorable discharge or bad conductdischarge shall be executed until approved by the governor. Heshall approve the sentence or such part, amount, or commuted formof the sentence as he sees fit, and may suspend the execution ofthe sentence or any part of the sentence, as approved by him.

2. All other court-martial sentences, unless suspended, maybe ordered executed by the convening authority when approved byhim. The convening authority may suspend the execution of anysentence.
