40.265. Any person who:
(1) Procures his own enlistment or appointment in the statemilitary forces by knowingly false representation or deliberateconcealment as to the person's qualifications for that enlistmentor appointment and receives pay or allowances thereunder; or
(2) Procures his own separation from the state militaryforces by knowingly false representation or deliberateconcealment as to the person's eligibility for that separationshall be punished as a court-martial may direct.
