Hostile forces, capture--conduct improper--court-martial.

40.355. Any person subject to sections 40.005 to 40.490shall be punished as a court-martial may direct who, while in thehands of a hostile force in time of war or civil disturbance:

(1) For the purpose of securing favorable treatment by theperson's captors, acts without proper authority in a mannercontrary to law, custom, or regulation, to the detriment ofothers of whatever nationality held by a hostile force ascivilian or military prisoners; or

(2) While in a position of authority over such personsmaltreats them without justifiable cause.
