Antiterrorism fund created, purpose--reversion to general revenueprohibited--governor to direct expenditures--antiterrorismactivities defined.

41.033. 1. The "Antiterrorism Fund" is hereby established within thestate treasury. The state treasurer shall be custodian of the fund, inaccordance with sections 30.170 and 30.180, RSMo, and shall makedisbursements from said fund for the purposes enumerated in subsection 2 ofthis section. All contributions derived from section 301.3123, RSMo,private donations and grants, or any appropriations made by the generalassembly, shall be placed in the antiterrorism fund. Notwithstanding theprovisions of section 33.080, RSMo, to the contrary, moneys in theantiterrorism fund shall not revert to the general revenue fund. Interestaccruing to the antiterrorism fund shall be part of the fund.

2. The antiterrorism fund shall, upon appropriation, be used by theMissouri office of homeland security for antiterrorism activities.Expenditures from the fund shall be made upon the direction of the governorfor antiterrorism activities. As used in this section, the term"antiterrorism activities" means activities related to the prevention,detection, and emergency response to terrorism that are undertaken by stateand local law enforcement, fire protection, and public health agencies.The funds provided for these activities, to the extent that funds areavailable, shall be used exclusively for purposes directly related tofighting terrorism. Eligible activities include, but are not limited to,hiring support staff to perform administrative tasks, hiring and trainingadditional law enforcement, fire protection, and public health personnel,response training for existing and additional law enforcement, fireprotection, and public health personnel, and hazardous materials and otherequipment expenditures.
