Birth certificate records of missing children to be flagged atrequest of patrol.

43.407. 1. Upon notification by the patrol that a child born in thisstate is missing, the registrar shall mark the birth certificate record ofthat child in such a manner that whenever a copy of the birth certificate orinformation regarding the birth record is requested, the registrar shall bealerted to the fact that the certificate is that of a missing child.

2. In response to any inquiry, the registrar may provide a copy of abirth certificate or information concerning the birth record of any childwhose record is marked pursuant to this section, but shall proceed as follows:

(1) When a copy of the birth certificate of a child whose record hasbeen marked is requested in person, the registrar's personnel accepting therequest shall immediately notify his supervisor. The person making therequest shall complete a form supplying his name, address, telephone number,Social Security number and relationship to the missing child and the name,address and birth date of the missing child. The driver's license of theperson making the request, if available, shall be photocopied and returned tohim. The registrar's personnel shall note the physical description of theperson making the request, and, upon the latter's departure from theregistrar's office, the supervisor shall immediately notify the missingpersons unit of the highway patrol as to the request and the informationobtained pursuant to this subsection. The registrar shall retain the formcompleted by the person making the request.

(2) When a copy of the birth certificate of a child whose record hasbeen marked is requested in writing, the registrar's personnel receiving therequest shall immediately notify his supervisor. The supervisor shallimmediately notify the missing persons unit of the highway patrol as to therequest and shall provide a copy of the written request. The registrar shallretain the original written request.
