43.500. As used in sections 43.500 to 43.543, the following termsmean:
(1) "Administration of criminal justice", performance of any of thefollowing activities: detection, apprehension, detention, pretrialrelease, post-trial release, prosecution, adjudication, correctionalsupervision, or rehabilitation of accused persons or criminal offenders.The administration of criminal justice shall include criminalidentification activities and the collection, storage, and dissemination ofcriminal history information, including fingerprint searches, photographs,and other unique biometric identification;
(2) "Central repository", the division within the Missouri statehighway patrol responsible for compiling and disseminating complete andaccurate criminal history records and for compiling, maintaining, anddisseminating criminal incident and arrest reports and statistics;
(3) "Committee", criminal records and justice information advisorycommittee;
(4) "Comparable ordinance violation", a violation of an ordinancehaving all the essential elements of a statutory felony or a class Amisdemeanor;
(5) "Criminal history record information", information collected bycriminal justice agencies on individuals consisting of identifiabledescriptions and notations of arrests, detentions, indictments,informations, or other formal criminal charges, and any disposition arisingtherefrom, sentencing, correctional supervision, and release;
(6) "Final disposition", the formal conclusion of a criminalproceeding at whatever stage it occurs in the criminal justice system;
(7) "Missouri charge code", a unique number assigned by the office ofstate courts administrator to an offense for tracking and groupingoffenses. Beginning January 1, 2005, the complete charge code shallconsist of digits assigned by the office of state courts administrator, thetwo-digit national crime information center modifiers and a single digitdesignating attempt, accessory, or conspiracy. The only exception to theJanuary 1, 2005, date shall be the courts that are not using the statewidecourt automation case management pursuant to section 476.055, RSMo; theeffective date will be as soon thereafter as economically feasible for allother courts;
(8) "State offense cycle number", a unique number, supplied by orapproved by the Missouri state highway patrol, on the state criminalfingerprint card. The offense cycle number, OCN, is used to link theidentity of a person, through unique biometric identification, to one ormany offenses for which the person is arrested or charged. The OCN will beused to track an offense incident from the date of arrest to the finaldisposition when the offender exits from the criminal justice system;
(9) "Unique biometric identification", automated methods ofrecognizing and identifying an individual based on a physiologicalcharacteristic. Biometric identification methods may include but are notlimited to facial recognition, fingerprints, palm prints, hand geometry,iris recognition, and retinal scan.
