Sprinkling or oiling of streets--special ordinance.

80.150. Upon completion of the hearing, in case the board oftrustees shall determine that the petition contains the necessarynumber of signers sufficient to satisfy the statute, suchdecision and determination shall be final and a special ordinanceshall be drafted by the board of trustees, in conformity withsection 80.110; provided, that whenever the majority of theowners of the property liable to taxation therefor residing insuch town or village shall remonstrate against the sprinkling,oiling, or otherwise treating of any street, avenue, alley, orstreets, avenues, alleys and such public places, then the boardof trustees shall have no power to let a contract therefor or toperform the work of sprinkling, oiling or otherwise treating onbehalf of such town or village. The provisions of the saidordinance shall be executed by the board of trustees and anaccurate account of the cost thereof kept by the town or villageclerk, or shall be contracted for annually by the board oftrustees at such time and under such terms as shall be providedfor by ordinance or until such ordinance is repealed uponpetition of seventy percent or more of resident property owners.
