Violations of city property maintenance code, liability--constructionof new units (Kansas City).

99.132. 1. The provisions of this section shall apply tohousing authorities of any city with a population of more thanfour hundred fifty thousand inhabitants which is located in morethan one county.

2. Notwithstanding the provisions of section 99.130, anysuch housing authority shall be liable for violations of thecity property maintenance code in single-family or duplex unitsby tenants of the housing authority or by the housing authority.The executive director of the housing authority, appointedpursuant to section 99.050, or, if no executive director isappointed, the chairman of the housing authority or, if achairman is not designated, the senior member of the housingauthority shall be the person held responsible for suchviolations, shall be the person upon whom service of process isserved, and shall be subject to any penalty provided by law.

3. The housing authority shall make payments in lieu oftaxes for any single-family or duplex unit to the schooldistricts located wholly or partially within the city in thesame amount as if such property were subject to taxation withinsuch school district based on the latest assessed valuation ofsuch property.

4. Subject to the provisions of subsection 5 of section99.110, when the housing authority acquires, purchases orconstructs additional single- or multiple-family units, all suchacquisitions, purchases or construction, shall be scattered insuch a manner that the additional units are dividedproportionately among all school districts located wholly orpartially within the city, in accordance with the proportion ofeach school district's population within the city to thepopulation of the city as a whole, based upon the most currentUnited States Bureau of the Census data. Further, within allsuch school districts, except the urban school district thegreater portion of which lies within the city, no additionalunit may be acquired, purchased or constructed in any censustract, as defined by the Bureau of the Census, within aparticular school district, except in the census tract or tractswholly or partially located within the city, which have theleast number of units within the school district.
