Membership in year 2000 plan.

104.1009. 1. The membership of the year 2000 plan shall include thefollowing persons:

(1) Each person who first becomes an employee on or after July 1,2000, and continues to be an employee;

(2) Each person covered by the closed plan on July 1, 2000, whoelects to be covered by the year 2000 plan in accordance with theprovisions of section 104.1015.

2. In any case of question as to the membership status of any person,the appropriate board shall decide the question. If a person is notincluded in membership at time of employment and is later determined to bea member, the board is authorized to collect any contribution shortfall byrequesting a special appropriation from the office of administration. Uponreceipt of such appropriation or if funds are otherwise lawfully available,the office of administration shall immediately pay to the system the amountneeded to cover such shortfall.
