Military service, purchase of prior service credit, refund tosurviving spouse when death occurs before retirement, procedure,limitation.

104.343. The surviving spouse of any deceased member whopurchased creditable prior service for service in the armedforces of the United States pursuant to subsection 4 of section104.340 and who died prior to retirement may, upon writtenrequest, receive a refund of the amount contributed for suchpurchase of creditable prior service, provided the survivingspouse is not entitled to a survivorship benefit as payable underthe provisions of section 104.420.
