Elective state officers entitled to normal annuity, how computed,exception--additional service, how credited--retirement age,statewide officer, annuity, amount.

104.371. 1. The normal annuity of a state official holding anelective state office, other than a member of the general assembly, shallbe an amount equal to one and six-tenths percent of the averagecompensation of such elective or appointed officer multiplied by the numberof years of creditable service of such elective or appointed officer;except that, if a member has held one or more statewide state electiveoffices for a total of at least twelve years, the member's normal annuityafter September 28, 1983, shall be equal to fifty percent of thecompensation provided by law at the time of retirement for the stateofficer of the highest office held, other provisions of lawnotwithstanding. The benefits shall be funded as provided in section104.436.

2. Any member who has served in at least three full biennialassemblies as a member of the general assembly may elect to be creditedwith additional service as a state officer or employee for each year inwhich he or she served as a member of the general assembly with each fullbiennial assembly served counting as two years of service and each partialbiennial assembly served counting as the pro rata portion of two yearswhich is equal to the portion of the general assembly served.

3. Any member who terminated employment prior to August 28, 1994, whohas served in at least three full biennial assemblies as a member of thegeneral assembly, may upon application to the board of trustees of theMissouri state employees' retirement system, be made, constituted andappointed and employed by the board as a special consultant on the problemsof retirement, aging and other state matters for the remainder of themember's life. Upon request of the board, the consultant shall giveopinions or be available to give opinions in writing or orally in responseto such requests. As compensation for such services, the consultant mayelect to be credited with additional service as a statewide electedofficial or employee for each year in which he or she served as a member ofthe general assembly, with each full biennial assembly served counting astwo years and each partial biennial assembly served counting as the prorata portion of two years which is equal to the portion of the generalassembly served.

4. Any elected statewide officer may retire after attainingfifty-five years of age and having had at least ten years of vestingservice. In such case, such elected officer shall receive an annuity in anamount which is the actuarial reduction approved by the board of the normalannuity the member would have received commencing at the earliest date onwhich the member is entitled to an unreduced benefit based on the member'screditable service at the date such member left office.

5. Any member who may retire as an elected statewide officer who hasattained sixty years of age and has at least fifteen years of creditableservice may retire with a normal annuity benefit.

6. Any member who may retire as an elected statewide elected officershall be entitled to retire with a normal annuity if the sum of themember's age and creditable service equals eighty years or more and if themember is at least fifty years of age.
