Minimum monthly benefits.

104.615. 1. Notwithstanding provisions of other sectionsof this chapter to the contrary, but subject to the provisions ofsubsection 2 of this section, the total minimum monthly benefitpayable, before any actuarial adjustments or any cost of livingadjustments in accordance with sections 104.415 and 104.612, to amember of the state employees' retirement system or a member ofthe transportation department employees' and highway patrolretirement system who retires under the provisions of section104.080, 104.095, 104.100, 104.110, 104.140, 104.380, 104.400 or104.410 shall not be less than fifteen dollars multiplied by thenumber of full years of creditable service of the member. Aminimum benefit under this section does not apply to any deferrednormal annuity or any deferred partial annuity. A minimumbenefit under this section is applicable in the determination ofany benefit payable under section 104.420 to a survivor of anemployee who dies on or after January 1, 1995. Specialconsultants shall give an oral summary of opinions on aging, ifso requested, as an extra duty for which additional compensationshall be paid as provided in this section. Any additionalcompensation payable to any member under the provisions of thissection shall be consolidated with any other retirement benefitspayable to such person, and funding for such compensation shallbe provided as set forth in section 104.436.

2. In determining the amount due a member under theprovisions of this section, the following provisions shall apply:

(1) Any election made by the member under the provisions ofthis chapter to receive the actuarial equivalent of the member'sannuity in reduced monthly payments shall not increase the amountof any compensation due the member under the provisions of thissection, and the determination shall be based on the amount themember's monthly payments would have been had such an electionnot been made;

(2) Any payments authorized by the member to be made fromthe monthly payments for payment of insurance premiums or othersuch purpose shall not increase the amount of compensation duethe member under the provisions of this section, and thedetermination shall be based on the amount of the payments beforesuch premium payments are made.
