Board of education to be notified of need of surrogate, when,appointment, when.

162.998. 1. Whenever a school district, special district,state agency or other political subdivision responsible forproviding education to handicapped or severely handicappedchildren is informed of a handicapped or severely handicappedchild living within its jurisdiction, it shall, within thirtydays, determine whether such child is in need of a person to actas a surrogate parent. Not more than ten days after thedetermination that such need exists, the school district, specialdistrict, state agency or other political subdivision shallnotify the state board of education in writing of itsdetermination. Such notification shall be accompanied by allsupporting documentation. Within thirty days of suchnotification, the state board of education shall appoint a personto act as a surrogate for the parent or guardian of the child.

2. Any person may advise a school district, specialdistrict, state agency or other political subdivision that ahandicapped or severely handicapped child within its jurisdictionmay be in need of a person to act as a surrogate parent.
