One-time transfer from incidental fund to capital projects fundpermitted, amount, qualifications--termination date.

165.018. 1. Any school district shall be permitted to make a one-timeadditional transfer from the incidental fund to the capital projects fund inan amount not to exceed forty percent of that district's June 30, 2006,incidental fund if such school district meets one of the followingqualifications:

(1) Has an average daily attendance between nine hundred forty and onethousand forty during the 2004-2005 school year, located at least partially ina county of the third classification with a township form of government andwith more than twenty-nine thousand seven hundred but fewer than twenty-ninethousand eight hundred inhabitants and which entirely encompasses a city ofthe fourth classification with more than one thousand one hundred but fewerthan one thousand two hundred inhabitants; or

(2) Has an average daily attendance between six hundred and six hundredthirty during the 2004-2005 school year, located at least partially in anycounty of the second classification with more than fifty-five thousand sixhundred but fewer than fifty-five thousand seven hundred inhabitants; or

(3) Has an average daily attendance between four hundred sixty and fourhundred ninety during the 2004-2005 school year, located at least partially inany county of the third classification without a township form of governmentand with more than twenty-three thousand two hundred fifty but fewer thantwenty-three thousand three hundred fifty inhabitants; or

(4) Has an average daily attendance between one thousand four hundredand one thousand five hundred during the 2004-2005 school year and is locatedentirely within a county of the third classification without a township formof government and with more than twenty thousand but fewer than twentythousand one hundred inhabitants.

2. The provisions of this section shall terminate on July 1, 2007.

2. The provisions of this section shall terminate on July 1, 2007.
