District not accredited shall pay tuition and transportation,when--amount charged.

167.131. 1. The board of education of each district inthis state that does not maintain an accredited school pursuantto the authority of the state board of education to classifyschools as established in section 161.092, RSMo, shall pay thetuition of and provide transportation consistent with theprovisions of section 167.241, RSMo, for each pupil residenttherein who attends an accredited school in another district ofthe same or an adjoining county.

2. The rate of tuition to be charged by the districtattended and paid by the sending district is the per pupil costof maintaining the district's grade level grouping which includesthe school attended. The cost of maintaining a grade levelgrouping shall be determined by the board of education of thedistrict but in no case shall it exceed all amounts spent forteachers' wages, incidental purposes, debt service, maintenanceand replacements. The term "debt service", as used in thissection, means expenditures for the retirement of bondedindebtedness and expenditures for interest on bondedindebtedness. Per pupil cost of the grade level grouping shallbe determined by dividing the cost of maintaining the grade levelgrouping by the average daily pupil attendance. If there isdisagreement as to the amount of tuition to be paid, the factsshall be submitted to the state board of education, and itsdecision in the matter shall be final. Subject to thelimitations of this section, each pupil shall be free to attendthe public school of his or her choice.
