Lunch programs in urban districts--managers and assistants,designation, duties--deposit and withdrawal of funds.

167.221. 1. The board of directors of any urban schooldistrict which has established facilities for supplying lunchesto children attending any of the schools in the district inaccordance with the provisions of section 167.211, may designatethe secretary of the district or some other person as manager forany or all of the facilities in the schools and, by rule,prescribe his duties. The board may also designate and appointsubmanagers, cashiers and other employees to staff the facilitiesand, by rule, prescribe their duties or the board may delegate tothe manager the authority to employ the labor and assistancerequired to conduct the facilities; except that all persons whohandle or are responsible for any moneys in connection with theoperation of the facilities, or who have authority to sign orcountersign any checks upon any of the funds or accounts shall beappointed by the board and shall be required to give bond to thedistrict in the amount, and with such sureties as the boarddesignates, conditioned to faithfully account for all fundscoming into their possession, and for the faithful performance oftheir duties. The manager of the facilities shall keep full andaccurate accounts of all receipts, expenditures and disbursementsby the facilities under his direction and control, and shall onor before October first of each year deliver to the board acomplete report in writing showing the operations of thefacilities under his direction and control, and the receipts anddisbursements on account thereof for the preceding fiscal year.

2. The board may authorize the deposit of funds receivedfrom the operations of the facilities in the banks ordepositaries and in the amounts that the board determines, andmay designate the persons by whom and the purposes for whichchecks may be drawn thereon. All deposits shall be secured inthe manner provided in section 165.241, RSMo. If the boarddesignates depositaries for the receipts from the operation ofthe facilities, the treasurer of the school district shall not berequired to take into his custody or control any funds soreceived and so deposited, and neither he nor his sureties shallbe responsible for the funds not coming into his custody andcontrol.
