Establishment of night schools in certain districts--tuition--use ofschool buildings.

178.290. The school board in any urban district at itsdiscretion, and the school board of any other seven-directordistrict or of any metropolitan district, upon the receipt of apetition signed by fifty or more registered voters of the schooldistrict requesting the action, may establish and maintain nightschools, make all necessary rules and regulations therefor, fixthe rates for tuition of pupils above the age of twenty yearsand of others who are not entitled to receive free public schoolprivileges in the district, and have general charge and controlover the school. The school board may grant the use of, orlease, any of the public school buildings in the district to anyresponsible party for the purpose of conducting a night schooltherein. If the use of a school building is granted or leasedfor such purpose, the party using it shall keep it clean and ingood repair and leave it in as good condition as it was when hetook charge of it. If the party using the school building failsto comply with this section, the school board shall refuse himfurther use of it until he complies with this section.
