Cost of programs, how paid--school district may contract with otherdistrict to provide services, when--failure of contracting district topay, procedure.

178.297. 1. Each school district, except school districts which are apart of a special school district, and special school districts constitutingthe domicile of any handicapped or severely handicapped child for whom specialeducational services are provided pursuant to the provisions of subsection 1of section 178.296, shall pay toward the cost for the educational services theamounts provided in section 162.970, RSMo. Each school district, other thanspecial school districts, constituting the domicile of any nonhandicappedchild for whom an educational program is provided pursuant to the provisionsof subsection 1 of section 178.296 shall pay toward the cost of sucheducational program the per-pupil cost of the district providing theeducational program which exceeds the state aid per pupil of such district;however, the district providing the educational program shall not exceedmaximum allowable costs as determined by the state board of education. Aschool district providing an educational program pursuant to the provisions ofsubsection 1 of section 178.296 shall authenticate costs in a manneracceptable to the state board of education. A school district in whichcounty- or court-operated facilities for the care and protection of juvenilesare located may contract with another school district, government agency orprivate agency to provide the education program required by subsection 1 ofsection 178.296. Each receiving district shall annually submit a plan ofexpenditures for such students to the state department of elementary andsecondary education for its approval of charges for students which arereceived by the district.

2. The amounts, as provided in subsection 1 of this section, for whichthe domiciliary school district or special school district is responsible,shall be paid by such district directly to the serving district. The servingdistrict may send written vouchers for payment as provided in section 162.970,RSMo, and in event the responsible district fails to pay the appropriateamount within the time allowed in such section, the department of elementaryand secondary education shall proceed in the manner provided therein toenforce payment.
