Agencies to aid in publication of state publications--secretary ofstate to provide electronic repository, responsibilities--statelibrary to assist with electronic repository,responsibilities--participating libraries--rulemakingauthority.

181.110. 1. For the purpose of providing the services described inthis section, each agency shall have the following responsibilities andpowers:

(1) To submit to the state library electronically each publicationcreated by the agency in a manner consistent with the state's enterprisearchitecture;

(2) To determine the format used to publish;

(3) For those publications which the agency determines shall beprinted and published in paper, to supply the number of copies forparticipating libraries as determined by the secretary of state;

(4) To assign a designee as a contact for the state publicationsaccess program and forward this information to the secretary of stateannually.

2. For the purpose of providing the services described in thissection, the secretary of state shall have the following responsibilities:

(1) The secretary, through the state library, shall provide a secureelectronic repository of state publications. Access to the statepublications in the repository shall be provided through multiple methodsof access, including the statewide online library catalog and a publiclyaccessible electronic network;

(2) The secretary shall create, in administrative rule, the criteriafor selection of participating libraries and the responsibilities incumbentupon those libraries in serving the citizens of Missouri;

(3) The secretary shall set by administrative rule the electronicformats acceptable for submission of publications to the electronicrepository;

(4) The secretary may issue and promulgate rules to enforce,implement and effectuate the powers and duties established in sections181.100 to 181.130.

3. For the purpose of providing the services described in thissection, the state library shall have the following responsibilities, allto be performed in a manner consistent with e-government:

(1) The state library shall administer the electronic repository ofstate publications for access by the citizens of Missouri, and receive anddistribute publications in other formats, which will be housed and madeavailable to the public by the participating libraries;

(2) The state library shall ensure the organization andclassification of state publications regardless of formats and thedistribution of materials in additional formats to participating libraries;

(3) The state library shall publish regularly a list of allpublications of the agencies, regardless of format.

4. For the purpose of providing the services described in thissection, the participating libraries shall have the followingresponsibilities:

(1) To ensure citizens who come to the library will be able to accesspublications electronically;

(2) To maintain paper copies of those state publications thatagencies publish in paper that are designated by the secretary of state tobe included in the Missouri state publications access program;

(3) To maintain a collection of older state publications published bythe agencies in paper and designated by the secretary of state to beincluded in the Missouri state publications access program;

(4) To provide training for staff of other libraries to assist thepublic in the use of state publications;

(5) To assist agencies in the distribution of paper copies of statepublications to the public.

5. All responsibilities and powers set out in this section shall becarried out consistent with the provisions of section 191.863, RSMo.

6. Any rule or portion of a rule, as that term is defined in section536.010, RSMo, that is created under the authority delegated in thischapter shall become effective only if it complies with and is subject toall of the provisions of chapter 536, RSMo, and, if applicable, section536.028, RSMo. This section and chapter 536, RSMo, are nonseverable and ifany of the powers vested with the general assembly pursuant to chapter 536,RSMo, to review, to delay the effective date, or to disapprove and annul arule are subsequently held unconstitutional, then the grant of rulemakingauthority and any rule proposed or adopted after August 28, 2004, shall beinvalid and void.
