Schedule of fees established, rules--collection and deposit.

190.550. 1. The department of health and senior services shall byrule establish a schedule of fees to be paid by applicants for specificlicensure or accreditation under sections 190.001 to 190.250 and sections190.525 to 190.537; except that, such fee shall not be imposed for specificlicensure or accreditation of persons employed by volunteer ambulanceservices. Any rule or portion of a rule, as that term is defined insection 536.010, RSMo, that is created under the authority delegated inthis section shall become effective only if it complies with and is subjectto all of the provisions of chapter 536, RSMo, and, if applicable, section536.028, RSMo. This section and chapter 536, RSMo, are nonseverable and ifany of the powers vested with the general assembly pursuant to chapter 536,RSMo, to review, to delay the effective date, or to disapprove and annul arule are subsequently held unconstitutional, then the grant of rulemakingauthority and any rule proposed or adopted after August 28, 2005, shall beinvalid and void.

2. All fees imposed under this section shall be collected by thedepartment and deposited in the Missouri public health services fundestablished in section 192.900, RSMo. Moneys in the fund deposited underthis section shall be used upon appropriation by the general assembly forthe purpose of implementing the provisions of sections 190.001 to 190.250and sections 190.525 to 190.537. Notwithstanding the provisions of section33.080, RSMo, moneys deposited to the credit of the fund under this sectionshall not revert to the credit of general revenue at the end of thebiennium.
