Persons not to smoke in public places or meetings, except indesignated smoking areas--designation of space for smoking area,requirements.

191.767. 1. A person shall not smoke in a public place orin a public meeting except in a designated smoking area.

2. A smoking area may be designated by persons havingcustody or control of public places, except in places in whichsmoking is prohibited by the fire marshal or by other law,ordinance or regulation.

3. No public place shall have more than thirty percent ofits entire space designated as a smoking area.

4. A designated smoking area where state employees maysmoke during the work day shall be provided by each stateexecutive department and institution of higher education,provided such area can be adequately ventilated at minimum cost,within the physical confines of each facility.

5. A proprietor or other person in charge of a restaurantshall designate an area of sufficient size to accommodate usualand customary demand for nonsmoking areas by customers orpatrons.
