Boards of education to establish breakfast program--rules--waiver,procedure.

191.803. 1. By July 1, 1993, the board of education of each school inthis state in which thirty-five percent or more of the students enrolled inthe school on October first of the preceding school year were eligible forfree or reduced price meals shall establish a school breakfast program.

2. The department of elementary and secondary education may promulgaterules and regulations necessary for implementation of sections 191.800 to191.815 in compliance with federal guidelines pursuant to the provisions of 42U.S.C. 1773.

3. A school shall receive a waiver from the requirements of this sectionif the school board of the school district by majority vote adopts aresolution requesting a waiver.

4. A school district requesting a waiver must file in writingnotification that it has adopted a resolution which excuses the district fromthe requirements of this section. Such writing shall be filed with theMissouri department of elementary and secondary education. Such a waivershall be valid for a period of three years.
