Rulemaking authority, procedure.

191.937. 1. The director of the department of health and seniorservices may promulgate rules and regulations to implement the provisions ofsections 191.925, 191.928 and 191.934. The director of the department ofelementary and secondary education may promulgate rules and regulations toimplement the provisions of section 191.931. The directors of the departmentsof insurance, financial institutions and professional registration and socialservices may promulgate rules and regulations to implement the provisions ofsection 376.685, RSMo.

2. Any rule or portion of a rule, as that term is defined in section536.010, RSMo, that is created under the authority delegated in sections191.925 to 191.937 or section 376.685, RSMo, shall become effective only if itcomplies with and is subject to all of the provisions of chapter 536, RSMo,and, if applicable, section 536.028, RSMo. All rulemaking authority delegatedprior to August 28, 1999, is of no force and effect and repealed. Nothing inthis section shall be interpreted to repeal or affect the validity of any rulefiled or adopted prior to August 28, 1999, if it fully complied with allapplicable provisions of law. This section and chapter 536, RSMo, arenonseverable and if any of the powers vested with the general assemblypursuant to chapter 536, RSMo, to review, to delay the effective date or todisapprove and annul a rule are subsequently held unconstitutional, then thegrant of rulemaking authority and any rule proposed or adopted after August28, 1999, shall be invalid and void.
